What is Probate?

Probate is the official process of handling your estate – including all your money, property and possessions – after you die. 

This involves collecting all of your assets and settling any debts before what’s left is distributed to your beneficiaries. 

What happens when my estate goes to Probate?

If you’ve made a legally valid Will and named an executor, it will be up to them to decide how they proceed. If you haven’t drafted a Will, your next of kin will become the administrator of your estate.

They can either take on the complex task themselves, which involves applying for a grant of representation and calculating the often cumbersome inheritance tax bill further down the line.

Alternatively, the executor can pass this task on to our senior specialists – partner Clare King and director Mike Dunkley – who oversee your case to ensure everything runs smoothly.

How long does Probate take to process?

The length of time Probate can take usually depends on how complicated your estate is, and the cooperation of various parties involved.

It usually takes us around 6 weeks to process Probate, which is better than the 8-week average, although each case is different and the time it can take may vary.
